تحكم هذه الشروط تقديم خدمات تطوير الأنظمة والمواقع من CybPhantom. باستخدامك للموقع أو طلب الخدمة فإنك توافق عليها.These terms govern system and web development services by CybPhantom. By using the site or requesting a service, you agree to them.

1. نطاق الخدمة1. Scope of Service

يُحدَّد نطاق كل مشروع (الوحدات، الميزات، المدة) في عرض رسمي مكتوب قبل البدء. أي عمل خارج النطاق يُسعَّر في ملحق منفصل.Each project's scope (modules, features, timeline) is defined in a written formal quote before work begins. Any out-of-scope work is priced in a separate addendum.

2. الأسعار والعروض2. Pricing & Quotes

الأسعار المعروضة على الموقع استرشادية وليست عقداً أو فاتورة، وتُؤكَّد بعرض رسمي.Prices shown on the site are indicative, not a contract or invoice, and are confirmed in a formal quote.
تُضاف ضريبة القيمة المضافة (15%) حيثما تنطبق حسب الوضع الضريبي.VAT (15%) is added where applicable per tax status.

3. الدفع3. Payment

عربون 50% من مبلغ التأسيس عند توقيع العقد لبدء العمل، و50% المتبقية عند التسليم بعد قبول العميل.A 50% deposit of the setup fee on signing to start work, and the remaining 50% on delivery after client acceptance.
اشتراك الدعم (إن وُجد) يبدأ بعد التسليم ويُدفع مقدّماً شهرياً أو سنوياً.Support subscription (if any) starts after delivery and is paid monthly or annually in advance.
يُتاح الدفع عبر منصة وساطة (مستقل/بحر): العميل يودع أولاً، ولا يبدأ العمل قبل تأكيد الإيداع، وتُطلق الأموال للمطوّر بعد قبول التسليم.Escrow (Mostaql/Bahr) is available: the client deposits first, work does not start before deposit confirmation, and funds are released to the developer after delivery acceptance.
الاستضافة والدومين والخدمات الخارجية الاختيارية (API، بريد، دفع) تُفتح باسم العميل أو تُغطّى ضمن اشتراك الدعم بعد التسليم — لا تُشترى باسم المطوّر قبل استلام العربون.Hosting, domain, and optional third-party services (API, email, payments) are opened in the client's name or covered in the support subscription after delivery — not purchased in the developer's name before the deposit is received.
يُسلَّم النظام/الكود الكامل بعد سداد كامل المبلغ المتفق عليه.The full system/code is delivered after full payment of the agreed amount.

4. الملكية الفكرية4. Intellectual Property

يبقى السورس كود ملكاً للمطوّر ما لم يُتفق صراحةً على «التملّك الكامل» في العقد، وعندها تُنقل حقوق الاستخدام/الملكية كما هو محدد. تبقى بيانات العميل ملكاً للعميل.The source code remains the developer's property unless "full ownership" is expressly agreed in the contract, in which case usage/ownership rights transfer as specified. Client data remains the client's property.

5. التزامات العميل5. Client Obligations

يلتزم العميل بتزويد المعلومات اللازمة في وقتها، واستخدام النظام نظامياً، وعدم نسخ أو إعادة بيع الكود دون إذن، وتحمّل رسوم الجهات الخارجية (استضافة/APIs حكومية).The client agrees to provide needed information on time, use the system lawfully, not copy or resell the code without permission, and bear third-party fees (hosting / government APIs).

6. الدعم والصيانة6. Support & Maintenance

يشمل كل مشروع جولتَي تعديل مجانيتين ضمن النطاق. يتوفّر عقد دعم منفصل بوقت استجابة (SLA) متفق عليه.Each project includes two free revision rounds within scope. A separate support plan with an agreed response time (SLA) is available.

7. إخلاء المسؤولية7. Disclaimer

لا يوجد نظام برمجي خالٍ من المخاطر. تُحدّد في العقد ضوابط الحماية وحدود الدعم والمسؤولية عن سوء الاستخدام وخدمات الأطراف الثالثة والتعديلات اللاحقة، دون استبعاد أي مسؤولية لا يجوز استبعادها نظاماً.No software system is risk-free. The contract defines security controls, support limits, and responsibility for misuse, third-party services, and later modifications, without excluding liability that cannot lawfully be excluded.

8. القانون المطبّق8. Governing Law

تخضع هذه الشروط لأنظمة المملكة العربية السعودية، وأي نزاع يُحل ودّياً أولاً، وإلا فأمام الجهات القضائية المختصة في المملكة.These terms are governed by the laws of Saudi Arabia. Disputes are resolved amicably first, otherwise before the competent Saudi judicial authorities.

9. الأهلية9. Eligibility

باستخدامك لهذا الموقع أو طلب الخدمة، تُقر بأنك تبلغ 18 عاماً أو أكثر أو تتصرف بموافقة ولي أمرك الشرعي، وأنك تملك الأهلية النظامية للتعاقد وفقاً لأنظمة المملكة العربية السعودية.By using this website or requesting a service, you confirm that you are 18 years of age or older or acting with your legal guardian's consent, and that you have the legal capacity to enter into contracts under Saudi law.

10. طبيعة النشاط10. Nature of Business

هذا النشاط مسجّل كـعمل حر. مستقل مرخص — يمكن تقديم بيانات التحقق عند الطلب. جميع العقود والالتزامات تكون باسم الفرد المرخّص.This activity is registered as a freelance operation. Licensed freelancer — verification available upon request. All contracts and obligations are in the name of the licensed individual.

11. الشكاوى والنزاعات11. Complaints & Disputes

يحق للعميل تقديم شكوى عبر قنوات التواصل أدناه. يتم الرد خلال 24 ساعة إلى 5 أيام عمل حسب نوع الحالة. في حال عدم حل النزاع ودياً، يُحال للجهات القضائية المختصة في المملكة العربية السعودية.The client may submit a complaint via the channels below. Response time is 24 hours to 5 business days depending on case type. If the dispute is not resolved amicably, it is referred to the competent Saudi judicial authorities.

12. التواصل12. Contact

يمكن التواصل عبر قناة التواصل التجارية أو نموذج الطلب.Contact is available through the business contact channel or request form.
